Excursion services agreement
The parties to this agreement for the provision of excursion services (hereinafter referred to as the «Agreement») are an individual with legal capacity in accordance with the legislation of Denmark. An individual who has legal capacity in accordance with the legislation of Denmark, expressing an intention to purchase Excursion services (hereinafter — the «Traveller»), on the other hand, together referred to as the «Parties», have entered into this Agreement as follows.
1. Terms used in the Agreement.
1.1. «Website» — a set of Internet data (web pages) located on the Internet, united by a single theme, design, and a single domain address space. The start page of the Site is located on the Internet at https://www.petersburgtravel.com
1.2. «Excursion services» — a set of services provided by the Guide to the Traveler on the terms determined by the Guide on the Site.
1.3. «Agreement» — an agreement for the provision of a complex of excursion services concluded between the Guide and the Traveller.
1.4. «Advance payment» — a partial payment for the Excursion services by the Traveller prior to their provision by the Guide, on the terms determined by the Guide and the Traveller.
- The subject of the Agreement
2.1. Under this Agreement, the Guide undertakes to provide the Traveller with the Excursion services specified by the Guide on the Site, at a price, on time, and on terms as agreed.
2.2. Obligations of the Parties
2.3 The guide undertakes:
2.4. Provide Excursion services to the Traveller in full compliance with the terms of this Agreement and the terms posted by the Guide on the Site, including arriving at the excursion site without delay.
2.5. After the Advance payment of the Excursion Services, send the Traveller your contact details, telephone number and e-mail address, and an agreement.
2.6. The traveller undertakes:
2.7. Provide your phone number and email address for transfer to the Guide, arrive at the excursion site without delay, follow the Guide’s recommendations during the excursion.
2.8. Make an advance payment for excursion services.
2.9. In cases provided for in this Agreement, it is necessary to send a request for a refund to the Guide to be guided by the following: a request for a refund is sent by e-mail info@petersburgtravel.com in a refund request, the Traveller indicates his contact information as well as the reason for the refund, the refund amount, the date of payments, method of payment and details from which payments were made.
- Delivery and acceptance of services rendered.
3.1. If the Traveller, through no fault of the Guide, interrupts the excursion before its completion, the excursion services are considered rendered in full.
3.2. If the Guide, through no fault of the Traveller, interrupts the excursion before its completion, the Guide undertakes to offer a replacement or return to the Traveller the money paid by the Traveller under this Agreement for the provision of the Excursion Services, no later than within two weeks.
- Cost of services and payment procedure
4.1. The cost of excursion services is determined by the Guide. Until the conclusion of this Agreement, the Traveller is fully informed about the cost of the Excursion Services.
4.2. At the time of the conclusion of this Agreement, the Traveller paid the Guide the Advance payment for the provision of Excursion services using the technical means of the Site or by other legal means, by bank transfer.
4.3. Immediately after the provision of the Excursion services by the Guide, the Traveler is obliged to pay the remaining cost (if any) of the Excursion services in the manner agreed by the Parties.
- Responsibility of the Parties
5.1. The parties are released from liability for failure to fulfil obligations under the Agreement if this is caused by force majeure circumstances. In the event of force majeure circumstances, the terms for fulfilling the obligations established by the Agreement are extended for the period during which the force majeure circumstances are in effect, or, by agreement of the Parties, the Agreement is terminated, and the Guide returns the Advance payment to the Traveller.
- Termination and amendment of the Agreement. Other conditions.
6.1. All changes and additions to the Agreement are recognized as valid only if they are made in the same form in which this Agreement is concluded. Confirmation of the Parties to change the terms of this Agreement is a message from each of the Parties sent to the other Party in the relevant section of the Site (on the Order page), containing a list of changes that the relevant Party proposes to make to the Agreement (or to which it agrees).
